Comfort Trial Policy

Elite Comfort Solutions LLC (“Manufacturer,” “we” “our” or “us”) offers this Comfort Trial Policy (this “Policy”) only to the consumer who originally purchased a DwellSleep™ Mattress directly from www.dwellsleep.com (“you”) for your own use, and not for resale, and who continues to own the DwellSleep™ Mattress. This Policy governs refunds and exchanges for purchases made directly at www.dwellsleep.com. Retailers may offer their own policies; if you purchase from a retailer, please contact them for assistance with returns, refunds or exchanges. This Policy is separate from and in addition to the DwellSleep™ Limited Warranty; your Limited Warranty rights for defects apply regardless of this Policy.

Risk-Free Trial Period

We currently offer a 100-night comfort trial on your DwellSleep™ Mattress purchased directly from www.dwellsleep.com. We may update the trial period length prospectively, and the version posted at the time of your purchase will apply to your order (such period is the “Trial Period”).

“Risk‑Free” refers to the absence of restocking fees for qualifying returns during the Trial Period. Refunds and exchanges are subject to the terms and conditions of this Policy, including eligibility requirements, care and condition standards, and verification procedures as discussed below.

Minimum Trial Use

You must keep and sleep on your DwellSleep™ Mattress for at least thirty (30) nights from delivery to allow you to adjust. Refunds or exchanges under this Policy may be requested only after the 30-night period but must be made prior to expiration of the Trial Period.

Condition and Care Requirements for Refunds or Exchanges Under This Policy

To qualify for a Risk-Free refund or exchange under this Policy:

  • Your DwellSleep™ Mattress must be clean, free of odors, and undamaged, with no stains, tears, burns, or evidence of infestation.
  • Your DwellSleep™ Mattress must have been used with a waterproof mattress protector from the first day. As part of the refund or exchange process, we may request reasonable proof of waterproof mattress protector use (e.g., proof of purchase, a photo showing the protector on the mattress, and a photo of the protector law tag) to verify care and cleanliness.
  • Your DwellSleep™ Mattress must have been used on a firm non-spring foundation, bed frame or adjustable bed base that is structurally capable of supporting the weight of the mattress, user(s) and foundation and base with (x) either a solid surface (but not the floor) or slats no more than 4 inches apart; Full, Queen, King or California King size DwellSleep™ Mattresses also require a center supporting leg for any slat, (y) adequate center support for a Full, Queen, King or California King size DwellSleep™ Mattress and (z) at least 7 legs for King and California King DwellSleep™ Mattresses, at least 5 legs for Queen, DwellSleep™ Mattresses, and at least 4 legs for Twin and Full DwellSleep™ Mattresses.  As part of the refund or exchange process, we may request reasonable proof of your suitable foundation or base (e.g., proof of purchase, a photo showing close ups of the supports, legs, slats, frames, and a photo of the protector law tag) to verify compliance with these requirements.

These requirements are for the Trial Period pursuant to this Policy only and do not affect your rights under the Limited Warranty for manufacturing defects.

How Refunds and Exchanges Work

If you wish to seek a refund or exchange for your DwellSleep™ Mattress during the Trial Period as allowed hereunder, please contact us in the manner set forth below with your order number.  We will guide you through the process of seeking a potential refund or exchange under this Policy.  Upon approval of a refund or exchange, we will guide you through one of the following options, at our discretion based on your location:

  • Free pickup or return shipping arranged by Manufacturer;
  • Retention of the DwellSleep™ Mattress; or
  • Donation to a charitable organization in your community, where available.

If the charitable donation option is elected, we will provide instructions and ask for proof of donation, such as a dated receipt or pickup confirmation that includes the item description, your name, and the date, plus photos if needed.  Do not donate your DwellSleep™ Mattress until we approve the charitable donation option for your order.

Refunds, Credits, and Exchanges

  • Refund Method: Approved refunds under this Policy will be refunded to your original form of payment or credited as store credit, as you choose.
  • Timing: We initiate refunds within ten to fourteen business days after we have approved the refund for  your DwellSleep™ Mattress, as applicable under this Policy. Your bank or card issuer may take additional time to post the credit.
  • Fees: We do not charge restocking fees for qualifying returns under this Policy. If your DwellSleep™ Mattress is not in acceptable condition under this Policy, we may decline the refund or offer a partial refund, at our discretion.
  • Exchanges: If you prefer an exchange, we will coordinate pickup/return of your original DwellSleep™ Mattress and delivery of a replacement. Exchanged items are covered by the Limited Warranty from the original purchase date; the Trial Period continues to run from the original delivery date and does not reset upon delivery of a replacement unit.

Geographic and Eligibility Limits

This Policy applies to standard residential deliveries within the continental United States. Remote locations or non-standard access may require special arrangements. DwellSleep™ Mattresses purchased “as is,” “with all faults,” or as floor samples, or purchased from third-party retailers, are not eligible for this Policy.

Abuse, Excessive Requests, or Health and Safety

We may decline refunds and/or exchanges in cases of suspected abuse, fraudulent activity, or health and safety concerns (including infestation or biohazard risk). We may also limit the number of refunds and/or exchanges per household in our discretion.
